This Privacy Policy explains how Fitness Garden SIA (“Fitness Garden”, “we”, “us”, or “our”) collects, uses, stores, and protects your personal data when you use the Fitness Garden mobile application, website, and related services.

Fitness Garden is a fitness and wellness application. It is not a medical device, does not provide medical diagnosis, and does not replace professional medical advice, treatment, physiotherapy, or consultation with a qualified healthcare professional.

2. Data We Collect

Depending on how you use Fitness Garden, we may collect the following types of data:

Account data

• Nickname or display name
• Email address

Fitness and profile data

• Height and weight
• Fitness goals and preferences
• Workout history and completed workouts
• Liked, disliked, skipped, or preferred exercises
• Available workout equipment and workout locations
• Information you choose to provide about your fitness level, limitations, or preferences

App usage and technical data

• App interactions and feature usage
• Device type, operating system, app version, and language settings
• Crash logs, diagnostics, and performance data
• Approximate usage statistics used to improve the app

Payment and subscription data

If you purchase a subscription or other paid feature, payment is processed by the relevant app store or payment provider. We do not store your full payment card details. We may receive information about your subscription status, purchase ID, renewal status, and related payment confirmation data.

3. How We Use Your Data

We use your data to:

• Create and manage your account
• Generate and personalize workouts
• Adapt exercises to your goals, preferences, equipment, and workout history
• Provide app functionality, customer support, and service notifications
• Improve the app, user experience, content, and workout algorithms
• Monitor app performance, detect errors, and prevent abuse
• Manage subscriptions and access to Pro features
• Comply with legal, tax, accounting, and regulatory obligations

4. Legal Basis for Processing

Where the General Data Protection Regulation (GDPR) applies, we process personal data based on one or more of the following legal bases:

• Contract: to provide the Fitness Garden service you request
• Consent: where you choose to provide optional data or where consent is legally required
• Legitimate interests: to improve, secure, and operate our service
• Legal obligation: where we must retain or process data to comply with applicable laws

5. Apple Health and HealthKit Information

With your permission, the iOS version of Fitness Garden uses Apple HealthKit to read the following health and fitness information:

• Step count
• Active energy burned
• Apple Exercise Time

Access to Apple Health is optional. Fitness Garden currently reads this information and does not write information to Apple Health.

How we use Apple Health information

We use this information to:

• Display your activity metrics and activity rings within Fitness Garden
• Calculate your progress in step-based and active-calorie challenges
• Provide features directly related to your fitness activity

Processing and storage

Fitness Garden reads cumulative activity totals for relevant date ranges. Individual HealthKit samples, source-device information, and raw HealthKit records are not uploaded to Fitness Garden’s servers.

When you participate in an applicable step or calorie challenge, Fitness Garden calculates an aggregate progress total on your device. The app sends only the challenge identifier and aggregate progress total to Fitness Garden’s backend, where it is associated with your account and stored as challenge progress.

Apple Exercise Time is displayed within the app but is not uploaded as challenge progress.

Advertising and sharing

Fitness Garden does not sell HealthKit information or use it for advertising, marketing, profiling, or data mining. HealthKit information is not shared with advertising networks, data brokers, or external AI providers.

Aggregate challenge progress may be processed by infrastructure providers acting on behalf of Fitness Garden solely as necessary to operate and secure the service. These providers are required to protect the information appropriately and may not use it for their own purposes.

Retention and deletion

Raw HealthKit values are not retained by Fitness Garden after they are processed on the device. Aggregate challenge progress stored with your Fitness Garden account is retained according to the account and data-retention practices described in this Privacy Policy. You may request its deletion by deleting your account or contacting us.

Fitness Garden does not store HealthKit information in iCloud.

Your choices

You choose which Apple Health categories Fitness Garden may access. You can withdraw access at any time through the Health app by opening your profile, selecting Apps under Privacy, and choosing Fitness Garden.

Withdrawing permission stops future access to Apple Health information. It does not automatically delete aggregate challenge progress already stored by Fitness Garden; you can request deletion through the app or by contacting us.

6. Health and Fitness Information

Fitness Garden may process fitness-related information such as goals, workout activity, body measurements, preferences, and exercise history. This information is used to personalize your workout experience.

Fitness Garden does not provide medical advice, diagnosis, treatment, or emergency services. You are responsible for deciding whether a workout is suitable for you. If you have any medical condition, injury, pregnancy-related concern, or other health limitation, you should consult a qualified healthcare professional before using the app.

7. Data Sharing

We do not sell your personal data.

We may share limited data with trusted service providers who help us operate Fitness Garden, such as:

• Cloud hosting and database providers
• Analytics and crash reporting providers
• Authentication providers
• App store and payment providers
• Customer support and communication tools
• Legal, accounting, or compliance advisers where necessary

These providers may process data only as necessary to provide their services to us and must protect the data appropriately.

We may also disclose data if required by law, court order, regulatory authority, or to protect our rights, users, or service security.

8. Advertising and Analytics

Fitness Garden may use analytics tools to understand how users interact with the app and to improve functionality, performance, and content.

If the free version of the app includes advertising, advertising partners may process limited device and usage data to deliver and measure ads. Where required by law, we will ask for your consent before using data for personalized advertising.

9. Data Security

We use reasonable technical and organizational measures to protect your personal data, including encryption in transit where appropriate, access controls, and secure infrastructure practices.

No digital service can guarantee complete security. You are responsible for keeping your account login details confidential.

10. Data Retention

We keep personal data only for as long as necessary to provide the service, comply with legal obligations, resolve disputes, prevent abuse, and maintain business records.

If you delete your account, we will delete or anonymize your personal data unless we are legally required or permitted to retain certain information, for example for accounting, fraud prevention, legal compliance, or dispute resolution.

11. Account and Data Deletion

You may request deletion or anonymization of your account and personal data through our account deletion request form, or by contacting us at info@fitnessgarden.eu.

We may need to verify your identity before processing a deletion request. After deletion, some data may remain in backups for a limited period before being permanently removed according to our backup retention practices.

Depending on your location and applicable law, you may have the right to:

• Request deletion of your data
• Restrict or object to certain processing
• Withdraw consent where processing is based on consent
