These Terms and Conditions ("Terms") govern your access to and use of the Fitness Garden mobile application, website, and related services ("Service") provided by Fitness Garden SIA ("Fitness Garden", "we", "us", or "our").

By creating an account, accessing, or using Fitness Garden, you agree to these Terms. If you do not agree, please do not use the Service.

1. About Fitness Garden

Fitness Garden provides personalized workout and fitness content based on user goals, preferences, available equipment, workout history, and other information provided by the user.

2. Eligibility

You must be at least 13 years old to use Fitness Garden. If you are under the age of majority in your country, you may use the Service only with permission from a parent or legal guardian.

3. User Account

Some features require creating an account. You agree to provide accurate and up-to-date information and to keep your login details secure. You are responsible for all activity under your account.

4. Health and Fitness Disclaimer

Fitness Garden provides fitness and wellness content for general informational purposes only. The Service does not provide medical advice, diagnosis, treatment, rehabilitation prescription, or healthcare services.

You are responsible for deciding whether any workout or exercise is suitable for you. Consult a qualified healthcare professional before starting any exercise program, especially if you have a medical condition, injury, are pregnant, recently gave birth, or have any concerns about your health.

Stop exercising immediately if you feel pain, dizziness, shortness of breath, discomfort, or any other concerning symptoms.

5. Personalized Workouts

Fitness Garden may generate workout sessions based on information you provide, including your goals, preferences, available equipment, workout duration, fitness level, and previous activity. You are responsible for ensuring that the information you provide is accurate and up to date.

6. Subscriptions and Paid Features

Some features may require a paid subscription or in-app purchase. Subscription prices, billing periods, included features, and renewal terms will be shown before purchase.

If you purchase through Apple App Store or Google Play, payments, renewals, cancellations, and refunds are handled by the relevant app store provider under their own terms and policies.

You can manage or cancel subscriptions through your Apple ID or Google Play account settings, depending on where you purchased the subscription.

7. Acceptable Use

You agree not to:

• use the Service for unlawful, harmful, abusive, or fraudulent purposes;
• copy, modify, reverse engineer, or distribute the App or any part of the Service;
• interfere with the security, servers, systems, or normal operation of the Service;
• attempt to access another user’s account or data;
• misuse the Service in a way that may harm Fitness Garden, other users, or third parties.

8. Intellectual Property

The Service, including the app, software, design, videos, workout structure, text, branding, logos, and other content, is owned by Fitness Garden SIA or its licensors and is protected by intellectual property laws.

You may use the Service only for your personal, non-commercial purposes unless we give you written permission otherwise.

9. User Feedback

If you provide feedback, suggestions, or ideas about Fitness Garden, you allow us to use them to improve the Service without obligation to compensate you.

To the maximum extent permitted by law, Fitness Garden SIA shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any injury, loss, or damage resulting from your use of the Service or participation in workouts.

16. No Warranty

The Service is provided “as is” and “as available”. We do not guarantee that the Service will meet your specific expectations, fitness goals, or health outcomes.

17. Governing Law

These Terms are governed by the laws of the Republic of Latvia, unless mandatory consumer protection laws in your country of residence provide otherwise.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Service after changes means you accept the updated Terms.
